VALOR TERMS & CONDITIONS

These Terms and Conditions (“Terms”) govern your use of the Valor Super App and www.valor.co.za (collectively referred to as “Valor” or “the Service”), operated by BYY Strategic Services (Pty) Ltd (“we”, “our”, or “us”).
By accessing or using Valor, you agree to be bound by these Terms. If you do not agree, you must not use the Valor app or website.

1. WHO WE ARE

Valor is a product of BYY Strategic Services (Pty) Ltd, a South African company dedicated to personal safety innovation through voice-activated emergency technology.

2. OUR MISSION

Valor exists to protect, empower, and connect users to instant emergency support like armed response, medical teams and safety monitoring, all initiated by voice command. While we strive to respond with superhero speed, Valor functions as a technology platform that facilitates emergency communication and coordination. Valor itself does not provide direct medical or armed services.

3. ACCEPTANCE OF TERMS

By downloading, installing, registering, or using the Valor Super App or website, you:

Confirm that you are at least 18 years old, or using the app with guardian consent.
Accept and agree to comply with these Terms.
Consent to our Privacy Policy, which governs how we handle personal data under POPIA (Protection of Personal Information Act, South Africa) and GDPR (European Union).

4. SCOPE OF SERVICE

The Valor platform enables you to:

Trigger emergency alerts through voice or manual activation.
Share your geolocation with our command centre and authorised response partners.
Communicate during active emergencies for assistance and dispatch purposes.
Access subscription-based safety and protection features.

While we take every measure to ensure reliability, network conditions, device compatibility or third-party failures may occasionally affect performance. Valor’s powers are vast but not limitless.

5. USER RESPONSIBILITIES

To keep Valor functioning with precision, you agree to:

Provide accurate and up-to-date information during registration and setup.
Maintain your account credentials in confidence.
Test the app regularly to ensure it functions on your device.
Use the service only for genuine emergencies or permitted testing.
Avoid misuse, including false alarms, data tampering, or unauthorised access attempts.

Misuse of Valor or false panic activations may result in account suspension, fees from response partners or legal action under applicable law.

6. SUBSCRIPTIONS & FEES

Valor operates on a subscription basis via direct purchase, bank or insurer partnership or corporate inclusion.

Subscription fees, renewal periods and cancellation terms are determined by your provider or plan.
Failure to maintain payment may result in suspension of service.
All fees are displayed in South African Rand (ZAR) and include VAT unless otherwise specified.

Refunds or cancellations follow the Consumer Protection Act (CPA) and any applicable third-party provider policies.

7. EMERGENCY RESPONSE LIMITATIONS

Valor acts as a technology facilitator between you and licensed emergency response providers.

While our systems are designed for accuracy and speed:

We cannot guarantee the response time or outcome of third-party responders.
Valor’s services depend on mobile signal, data connectivity, and device performance.
Users are encouraged to ensure that location services and microphone permissions remain active at all times.

Valor and BYY Strategic Services (Pty) Ltd are not liable for delays, non-performance or indirect damages arising from network, hardware or third-party failures during emergencies.

8. PRIVACY & DATA PROTECTION

Your privacy is our oath of honour. Valor complies with both POPIA and GDPR, ensuring your personal data is processed lawfully, transparently, and securely. 9. INTELLECTUAL PROPERTY

All Valor content, including the app, website design, logos, trademarks, software, and written materials are owned or licensed by BYY Strategic Services (Pty) Ltd. You may not copy, modify, distribute or reverse-engineer any part of Valor without written permission.

10. TERMINATION & ACCOUNT CANCELLATION

We may suspend or terminate access to Valor immediately if:

You breach these Terms.
Your subscription lapses or remains unpaid.
Your use poses a risk to Valor systems or other users.

You may cancel your subscription or delete your account at any time by following the steps in the app or contacting info@valor.co.za. Upon cancellation, some data may be retained as required by law or for legitimate operational purposes.

11. LIABILITY

To the fullest extent permitted by law:

BYY Strategic Services (Pty) Ltd shall not be liable for indirect, incidental, or consequential losses arising from your use of Valor.
We are not responsible for the acts, omissions, or response times of third-party emergency providers.
Our total liability for any claim shall not exceed the total subscription fees paid in the preceding 12 months.

Valor is a safety ally but not a substitute for sound judgment or responsible action in an emergency.

12. INTERNATIONAL USERS & GDPR

If you access or use Valor outside South Africa, your information may be transferred and processed in other jurisdictions. Valor ensures such transfers comply with GDPR adequacy standards or equivalent safeguards to protect your data wherever it travels.

13. GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa.
Users outside South Africa agree that any disputes shall be subject to the exclusive jurisdiction of South African courts, without prejudice to mandatory data protection rights under GDPR.

14. AMENDMENTS

We may update or revise these Terms from time to time.
Revisions will take effect upon publication on www.valor.co.za, with the updated effective date noted above. Continued use of Valor after changes constitutes acceptance of the revised Terms.
